Litigation of COVID-Related Issues [VIRTUAL PROGRAM]
Program Details: We will be discussing expected litigation related to COVID-19 from the employee and employer perspectives. The discussion will include the FFCRA, COVID-related ADA requests, how to address PTO requests, whistleblower claims based on COVID concerns, and claims that COVID-related layoffs were based on age, disability, retaliation, or other protected categories or activities.
Presenters: Lauren S. Irwin and Dona Feeney
Lauren S. Irwin: Lauren S. Irwin is a partner with Upton & Hatfield, LLP in Concord, New Hampshire. Her practice involves primarily litigation, representing primarily plaintiffs in employment discrimination, sexual harassment, wrongful discharge, Family and Medical Leave Act, and other employment cases involving both federal and state law. Ms. Irwin regularly represents employees and employers before the New Hampshire Human Rights Commission, the New Hampshire Department of Employment Security, and the New Hampshire Department of Labor. In addition, Ms. Irwin has successfully litigated and resolved numerous employment cases in both the U.S. District Court for the District of New Hampshire and the superior courts. Ms. Irwin joined Upton & Hatfield, LLP after serving as a New Hampshire Superior Court law clerk. Attorney Irwin is a graduate of Boston University Law School and Wesleyan University. She is the former President and Member of the New Hampshire Chapter of the National Employment Lawyers’ Association. She is the former Chair of the Labor & Employment Section of the New Hampshire Bar Association, the former Chair of NHBA Gender Equality Committee, and the former Chair of the Federal Practice Section of the New Hampshire Bar Association. She is a member of the New Hampshire Association for Justice, the New Hampshire Council of School Attorneys, and the former Chair and Board Member of RB Productions. She was named Best Lawyers’ 2014-15 Concord Employment Law - Individuals “Lawyer of the Year,” named among Best Lawyers’ 2017 Women of Influence, and named Best Lawyers’ 2019 Employment Law – Individuals “Lawyer of the Year.” She is also a Fellow of The College of Labor and Employment Lawyers, and an Adjunct Professor at UNH School of Law. Ms. Irwin volunteers as a Mediator for the Superior Court Rule 170 Program and the New Hampshire Human Rights Commission Mediation Program. Ms. Irwin is a frequent speaker on employment law issues.
Dona Feeney: Dona Feeney is a partner with the Concord firm of Maggiotto, Friedman, Feeney and Fraas, PLLC. Ms. Feeney represents employers, municipalities, school districts and individual clients throughout New Hampshire and Massachusetts in the areas of employment law, discrimination, and wrongful termination. She appears regularly in state and federal courts as well at the various state and federal agencies that oversee workplace discrimination, retaliation and disability matters including the New Hampshire Commission for Human Rights, the Massachusetts Commission Against Discrimination, and the Equal Employment Opportunity Commission. Ms. Feeney has served as a mediator, including as a volunteer mediator with the New Hampshire Commission for Human Rights. She also conducts workplace investigations related to claims of harassment and discrimination. Ms. Feeney was raised in New Jersey and earned her B.S. and M.S. degrees in biological sciences from Rutgers University. After working for a number of years as a research assistant at the University of Medicine and Dentistry of New Jersey, Ms. Feeney pursued her legal studies at the Newark campus of Rutgers University School Law where she received her J.D. degree. She lives in Epping, NH where she enjoys spending time with her husband and their two Labrador retrievers.
